1. Agreement

By accessing or using the CarePlan Vigilance Tracker (“the Portal”), you agree to these Terms of Service.

If you do not agree, do not use the Portal.

2. Independent Contractor Relationship

CarePlan provides software tools only.

CarePlan does not:

• Employ workers
• Provide care services
• Supervise care activities
• Act as a care provider

Workers using the Portal remain independent contractors responsible for their own conduct and compliance obligations.

3. User Responsibilities

Users agree to:

• Enter accurate shift times
• Provide truthful notes
• Use GPS check-in correctly
• Keep login credentials secure
• Comply with applicable laws

You are responsible for all activity under your account.

4. GPS Consent

By using the Portal, workers consent to GPS location recording at shift check-in for compliance and verification purposes.

5. AI-Assisted Note Refinement

The Portal may use automated tools to refine or format shift notes.

Users remain solely responsible for:

• The accuracy of content
• Reviewing notes before submission
• Ensuring compliance with provider requirements

CarePlan does not guarantee the correctness of AI-generated refinements.

6. Data Hosting

The Portal is hosted in the United States (Arizona, with backups in Boston).

By using the Portal, users acknowledge and consent to overseas data storage.

7. System Availability

CarePlan does not guarantee uninterrupted or error-free service.

The Portal is provided “as is”.

Users should retain independent copies of critical records where required.

8. Limitation of Liability

To the maximum extent permitted by law:

CarePlan is not liable for:

• Inaccurate user-entered data
• Lost income
• Compliance penalties
• Service interruptions
• Third-party infrastructure failures

Total liability, if any, is limited to fees paid for use of the Portal.

9. Termination

CarePlan may suspend or terminate access if:

• Terms are breached
• Security is compromised
• Misuse is detected

Users may stop using the Portal at any time.

10. Governing Law

These Terms are governed by the laws of Victoria, Australia.

11. Changes

We may update these Terms periodically. Continued use of the Portal constitutes acceptance of updated Terms.
